General Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and FunnelMind.ai (maker of InstaSDR.ai) (“we,” “us,” or “our”), concerning your access to and use of the www.funnelmind.ai website, instasdr.ai, and any other media form, media channel, mobile website, or web application related, linked, or otherwise connected thereto (collectively, the “Site”).
By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use (including our Privacy Policy). If you do not agree, you are expressly prohibited from using the Site and must discontinue use immediately.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason.
We will alert you of any changes by updating the “Last Updated” date at the top of these Terms. It is your responsibility to review these Terms periodically. Continued use of the Site after any revisions constitutes your acceptance of those changes.
The Site is intended for users who are at least 18 years old. Persons under 18 are not permitted to register or use the Site.
Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, software, designs, text, images, video, audio, and graphics (collectively, “Content”), as well as trademarks, service marks, and logos (“Marks”), are owned or licensed by us and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited license to access and use the Site and to download or print portions of the Content for personal, non-commercial use. All other rights are reserved.
User Representations
By using the Site, you represent and warrant that:
- All registration information you submit is true, accurate, current, and complete.
- You will maintain the accuracy of such information.
- You have the legal capacity and agree to comply with these Terms.
- You will not use the Site for any unlawful purpose.
- Your use of the Site will not violate any applicable law or regulation.
If any information provided is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your account.
Fees and Payment
Some services may require payment. You agree to provide current, complete, and accurate billing and account information for all purchases made via the Site.
- Payments are processed through an online billing account.
- Sales tax will be applied where required.
- We reserve the right to change pricing at any time.
- All payments are in U.S. Dollars.
- If your purchase involves recurring charges, you authorize us to charge your payment method on a recurring basis until you cancel.
Renewal
Unless you notify us before the end of your subscription period that you wish to cancel, your subscription will automatically renew, and you authorize us to collect the applicable subscription fees (including taxes) using your payment method on file.
Cancellation and Refunds
- Monthly purchases are non-refundable.
- Annual plans are refundable within 24 hours after we receive your payment.
- You may cancel at any time via your dashboard (Billing tab → Cancel Subscription) or by contacting us at hello@instasdr.ai.
- Cancellations take effect at the end of the current billing term.
- Additional services offered by our team are non-refundable.
Software
If software is included as part of our services, its use will be governed by an accompanying End User License Agreement (EULA). If no EULA is provided, you are granted a limited, revocable, non-exclusive, non-transferable license to use the software solely in connection with our services.
All software is provided “as is,” without warranties of any kind.
Prohibited Activities
You agree not to:
- Use the Site for any unlawful or unauthorized purpose.
- Access or attempt to access the Site through automated means (bots, scrapers, etc.).
- Interfere with the security, functionality, or performance of the Site.
- Copy, reproduce, or exploit Site Content for commercial purposes without permission.
- Upload malware, viruses, or harmful material.
- Harass, abuse, or harm any employee, agent, or user of the Site.
- Attempt to reverse engineer, decompile, or modify our software.
- Use the Site to compete with FunnelMind.ai or for any revenue-generating endeavor not authorized by us.
Google API Data Compliance
If our services connect to Google APIs (e.g., Gmail), we comply with the Google API Services User Data Policy, including the Limited Use requirements:
- We only request the minimum data necessary.
- We do not use Google data for advertising or share/sell it to third parties.
- Human access to your data is strictly limited to security, compliance, or debugging.
- We maintain strong safeguards to protect user data.
Disclaimer
The Site is provided “as is” and “as available.” You use it at your own risk. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
FunnelMind.ai (maker of InstaSDR.ai) is not produced, endorsed, or certified by LinkedIn. LinkedIn™ logos and trademarks remain the property of LinkedIn.
Limitation of Liability
In no event shall FunnelMind.ai, InstaSDR.ai, or its licensors/suppliers be liable under contract, negligence, strict liability, or other theory for:
- Any special, incidental, or consequential damages;
- Costs of substitute products or services;
- Data loss or corruption;
- Amounts exceeding fees paid by you in the 12 months preceding the cause of action.
These limitations may not apply where prohibited by law.
Miscellaneous
- These Terms constitute the entire agreement between you and FunnelMind.ai regarding use of the Site.
- We may assign our rights and obligations at any time.
- If any provision is deemed unlawful or unenforceable, the remaining provisions remain valid.
- No joint venture, partnership, or employment relationship exists as a result of these Terms.
- These Terms shall not be construed against us for having drafted them.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles. You agree that any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you hereby consent to the personal jurisdiction of such courts.
